Can anyone tell me the laws regarding a handgun trade in Alabama? I have a coworker that wants to trade handguns and Im kind of interested. Anything that I should be aware of? Possibly by this Sat or Sunday.

Pretty much if both parties would be legally able to walk into a FFL and purchase a handgun, there aren't any restrictions on trading.

But how would I know if my co worker was cool? Should I ask to go to the local PD for a background check?

What I usually do is prepare two copies of a Bill of Sale. I put model, make, serial number and price of the firearm. I also ask for ID (usually the Driver's License number) and put that on the BoS.

I let the other party know all of this up front, and if there is any hesitation, I walk away.

I have also been known to ask for a valid Pistol Permit, but that is when I feel any bad vibes during the transaction.

My Bos contains this verbiage:
I hereby certify that I am the sole, lawful owner of said firearm, that it is free from all encumbrances, that I have good and legal right to sell the firearm, and will warrant and defend the sale against the lawful claims and demands of all persons whomsoever. I further release it from all interest and liabilities as of this date.

This firearm is sold “as is,” with no warranties implied.

Both parties agree to abide by all Federal, State, and local laws pertaining to this transaction. Both parties attest to the following:

1. Parties are residents of the State of Alabama,
2. Parties are legally permitted to own such a firearm, and
3. Parties are legal citizens of the United States.



Both parties sign and date this, and each keeps a copy. I'm not a lawyer, but I think I am covered by what I do. YMMV.

If you have no knowledge or reason to believe that someone is prohibited from possessing it, it is my understanding that is all that is required.

If it's causing you so much hesitation and headaches, just go to your local FFL and have him accept both firearms and transfer them to each party. CYA, bases covered, etc.

h2o-5o, bamabud, Thanks for the info. I will print that out. Im just worried about "Hot" guns. Im not saying that he is a crook or thief or the gun is even "Hot". Im just saying. I want to protect my *** from such.

I also tell the seller that I will take the firearm to the PD, AFTER I buy it, for them to run the serial number. Any hesitation, I walk, too. Since I have their ID and signature, checking with the PD really puts me at ease.

I always do this, too. The local PD comes by my house all the time to run the numbers. Have made a few good acquaintances that way!:cool:

The only time I didn't run the numbers was when I bought FROM an LEO (maybe I should have then too, but didn't). YMMV.

Bamabud, That is exactly what happened. I ask if he had any problem riding over to the local PD and have his handgun ran. With a loud tone and suprise. He was like "what for!?" "You dont trust me!?" That set off a Red light for me and I said to him that he should do the same. He was like "I trust you man!" "You should trust me!" literally yelling the entire time. I calmly said "No Deal". Thanks everybody for all the info. mossy

If the guy has an Alabama permit to carry concealed, he should be good to go. I usually require one as proof of legality for a trade or sale. Let the high sheriff of your county do the legwork!

Damn! Too late... I just went and put a New Ruger on Layaway @ Pawn City.

Im getting the New Ruger LCR .38 spl. Hopefully I can find ammo for it. lol! Thanks anyway.

Did you have the chance to handle the Ruger LCR? Amazingly lightweight.

yeah, i handled it. if my eyes were closed i had no problems with it.

it felt about the same as my S&W airweights so it didnt do anything for me there.

its factory grip was nice, but a lot larger than my J frames, me thinks that will hamper concealment.

the general shape of it will make finding an assortment of holsters difficult unless you get the generic nylon one size fits some holsters.

i applaud Sturm Ruger for their enginuity and they give folks another choice and thats a good thing, but i dont see the practical side of it at all.

No not yet. I found it cheaper somewhere else and its on layaway. Beats the heck out of the old Rossi or Taurus.

I am not willing to pay $200 more for a S&W. I just cant see it. no way. Smiths are Nice but Not that nice. IMHO.....:whistling:

yeah, im not crazy about built in locks either....thank God somebody are Ruger was smart enough to NOT put them on the sp101...yet...wonder why they did it with the LCR?

Shoots Great! A little snappy for a .38Spl but I like it. Light, accurate, and Very concealable. I dont buy expensive holsters So I slipped her in and old uncle mikes IWB and she feels fine. Hardly knows that the gun is even there. I like it. $$$ well spent. Now if I could just find some good ammo.
