A Florida gun shop staff member told me about he used his firearm for self defense. It was 8 years ago, and no charges were made against him.

It raises a question in my mind. Do we as armed citizens, run the risk of losing our firearm once used for self defense, assuming the proper situation and circumstances? What is the protocol in most cases when a firearm is taken into custody for the court system?

It's evidence, so it's collected as such.

It's normally returned to the legitimate owner after the case is adjudicated in the owner's favor.

Though I've seen the defendant have to fight to get his gun back even after being acquitted.

Thanks, Mas.

It sounds like a quite costly process to get it back, depending upon locale.
