I don't know what the exact legalities are, but obviously an EO can bypass/overrule/supercede/negate COTUS if they either cooperate or are too gutless to stand up for the authority the constitution gives them. I suspect we may be seeing the later today. Members of congress seem to be more interested in keeping their positions and perks than they are in representing the interests of the people they should be serving.

EOs tell the Executive Branch how they're to act or how they're to implement a law. No one gets prosecuted for failing to obey an EO. No one outside the executive has to follow an EO. (The underlying Congressional legislation, yes, but not the EO.)
