These are law professors and (genuine) Constitutional scholars writing here, and they're confused. One of them has even been quoted several times in the actual published opinions of the Court. As I said in another thread, SCOTUS is the closest thing we have to a coven of wizards, and predicting or explaining their process is a low-percentage thing.

It would have been easier for everyone if the SC had just fixed this for us....

But a lazy electorate makes bad things happen.

We must get to work and fix this ourselves....

That's a good reminder that there was more than one constitutional issue at play. It was a big bill with a lot going on.
