These are law professors and (genuine) Constitutional scholars writing here, and they're confused. One of them has even been quoted several times in the actual published opinions of the Court. As I said in another thread, SCOTUS is the closest thing we have to a coven of wizards, and predicting or explaining their process is a low-percentage thing.
