We were "supposed" to not have to worry about that, because we're a "Republic", not a Democracy. But when two of the three branches of government shirk their duty to uphold the Constitution, well, we get what we have now. The Executive branch doing all of the executing.

The republic ended at about the time the seventeenth amendment was enacted. It's a downward spiral from here.
