I live in a state where SBRs are a nono. Question is if I bought a 10.5 AR upper for my collection but did not mount it on a receiver AT ALL would that still be considered having a SBR? Thanks in advance.

My guess (and it' merely that, a GUESS) is that that would be just as illegal.

The BATF has deemed that even unassembled parts are a weapon. Unless you have the proper paperwork, don't even try it. It's not worth the risk.
Just a thought: if you were to buy an AR15 pistol, or build a pistol from a virgin receiver, you would have a valid (legal) purpose to own a short upper.

yes it would be valid
PROVIDING the lower it is on does not have a buttstock, fixed or collaspable. that then classifies it as a SBR
