I may have an issue getting my form 4 approved...

Before we go any further, yes, I am able to have one. Reside in the Republic of Texas.

I went to see the CLEO of my area, the Chief of Police, and he signed my SBR permit, no problems there. Issue came up when I asked him if he would mind signing my form 4 for a suppressor later in the year. He told me that "No, don't think I can do that for you. I just don't like suppressors, or full auto weapons, so no, I'm not going to sign that for you". Now, I was under the impression that if I'm legal to own MG's, AOW's, cans, SBR's, ect. that I can't be refused, or if the CLEO won't sign it, then he has to give a written reason why. If this is so, is "I don't like them" a real reason? Or do I just need to go to a different CLEO in my area? (have several to choose from; judge, sheriff, ect)

If any one knows it, or knows where I can find it, I'd like to see the written law regarding this subject.

There is no law requiring the CLEO to sign on a federal level. THis is why the rise of LLC/trust transfers. THe CLEO can deny signing for any reason; he doesn't like your car, you stood his daughter up on prom night, etc. THere is no requirement for a denial letter/statement. You can try other valid CLEO's for their signatures.

I ran into the same problem when I transfered to Florida. So I formed a trust with the help of Quicken will maker and I am on my third title II item with no problems. As far as I know Tennessee is the only state where the CLEO can't refuse to sign.

As said above, go the Trust route, and he won't even know what you have. I have 2 on trusts. The local CLEO (PD) won't sign, the sherrif will, but some have said that he takes up to 10 weeks. I did a trust and had my Form 4 back 19 days from the date I mailed it.

OK... I understand some of setting up a LLC for the purpose, but not all. You have all mentioned setting up a trust, maybe could one of you break it down for me, give me a short and dirty version of what it takes to get. I have a good friend who's wife is a lawyer, so if I needed something along those lines I'm sure whe will help me.

Allright, that makes it clearer. Thanks sarge. Been talking to my friends wife, and she is setting me up with another legal eagle friend of hers who is more well versed in that area, so hopefully my signature woes will soon be a thing of the past. :hugs:
