View Full Version : Out of state SOT3 dealer: Legal to transfer to me?

MI recently allows MGs and suppressors. I don't think there are any SOT3 dealers in the UP. Do I have to go downstate and use a dealer in my state or can I have a WI SOT3 transfer it to me if I go there to pick it up? FWIW, suppressors are legal in WI. Looking at a 3-4hr drive versus 8-10hr drive one way.

You have to use an FFL/SOT in the same state for all title II transfers. The only time you can transfer directly from an out-of-state FFL is if you're buying a title I long arm.

Unfortunately, he's correct. You'll need a MI dealer. I'm sure there's gotta be a C3 FFL in the UP.

Thanks. That is what I figured, but wanted to ask anyways. I seriously doubt there is a SOT3 in the UP. I will be very surprised if their is. I sent an email over to impactguns to see if they know of any in the UP. They said on their site they will help you find a dealer that will do xfers.
Kind of sucks. I might be moving back to WI next year after the academy. Don't know if I will get hired in MI or WI. I should hold off on NFA until I know, but I figured I might be able to sweet talk my sheriff to signing off on my F4 so I don't have to corp. I don't mind doing it, but if I corp here in MI and then can't get a sign off in WI, I will have to move my corp there or form a corp in WI and xfer it from corp to corp which will be another $200. Just a lot easier if my sheriff would sign off. Then I can just move and send the letter to the ATF.

If you already own the Title 2 stuff in Michigan, and you move to Wisconsin, all you do is file an ATF Form 5320.20 (Application To Transport Interstate or to Temporarily Export Certain NFA Firearms).... No CLEO needed at destination, you already own stuff lawfully, and in WI, most all NFA is legal.
Better help with locating a FFL/SOT will be to hit the NFA Discussion Board at Subguns.com (http://www.subguns.com/boards/mgmsg.cgi), there is quite a few of MI residents there that are regular posters.

Before I moved here from WI, I was one week away from sending in my AofInc papers to form a corp. Then we decided to move so I din't send them in.
If I corped in MI and moved to WI, I would have to move my corp to WI and redo everything with the state. How would I handle the move with the ATF? Would I fill out the same form quoted above since corporations are treated as individuals for NFA regulations?
