What is required to legally own a machine gun and/or silence in Ohio (post-AWB). Any municpal restrictions on the Premption changes take affect?
Some Sheriffs will refuse to sign anyones forms, and they don't need a reason.
It varies by city and/or county in Ohio.
Now a days its getting hard to get your local L.E. rep. to sign. There have been law suits to get them to sign. Alot of $. Back in the day in the 1970,s our P.D. chief would sign. I am tranfering a M-10 45 suppresser to a gentleman in Sandusky Ohio area who was able to get his ATF transfer papers in order for his reg. M-10 45 buzz-saw. The weapons were froze in 1986 for civilians at what is on the books. Hence no new weapons or old can be added. Suppressers are still made.The supply of class-3 weapons is frozen and the price is going up by the second. Guns that were bought like the 1928 Thompson in 1970 for $500 sell for $20 to $30 thousand today for NFA legal. Priced out of reach for most.
Do silencers require the same LEO sign-off?
Can't an individual wishing to own Class III firearms here in Ohio form a corporation--called an 'LLC' I think--to make the paperwork go through easier?
Yes $200 tax stamp and same process as MG under 1934 destructive device Tax stamp ATF law.
Same PRocess as anywhere else in the country. get the CLEO sign off. If you cannot get the signoff, either form an LLC, (very easy, but expensive,) or use Quicken Willmaker to form a revocable Trust. The Trust Route is the easiest and fastest way. The Sign off is the Best way. The LLC route is for those of us who did not know about the Trust Route.
