The way I read it, IF the guy was shot in the backside, it sounds like it may very well be a bad shoot. i.e. you cannot shoot the guy if he is running away.

Maybe if it happened in the same community as the LEO chief that had a 'ND' and blamed it on that Glock being unsafe he could get off?

I have been told that the shooter will not be charged, but am unable to confirm that via Cinti news websites. Has anyone seen this story?
