EVANSVILLE, Ind. | A man trying to hold up a smoke shop fatally shot his partner when his gun went off during a struggle with the store owner, police said.
Earl Thomas, 31, of Palos Hills, Ill., collapsed on the gravel outside the Burn Em Smoke Shop seconds after he was struck by a round from a .38-caliber revolver Saturday evening.
The bullet struck Thomas in the left shoulder and punctured his aorta, causing him to bleed to death, said Vanderburgh County Coroner Don Erk.
Police arrested Freddy L. Shaw, 36, of Chicago on preliminary charges of murder, armed robbery with serious bodily injury, criminal confinement and battery.
Evansville police said Shaw intended to shoot store owner Jeremy D. Adams, 36, who had grabbed the gun barrel during the robbery and was attempting to wrest it from Shaw's grasp. The gun went off as the two struggled.
Shaw was being held without bond in the Vanderburgh County Jail. Prosecutor Stan Levco said it was unlikely that he would seek the death penalty against Thomas.
Adams told police the men beat him with their fists and with the gun, tortured him with a pair of pliers, then attempted to force him into the trunk of his car. They planned to take him to his home to steal money he had there, Adams said.
Police later arrested Adams following a search of his home, in which they found a stolen revolver, bullets, 60 grams of marijuana and $1,788 in cash. Adams was released on bond after being charged with receiving stolen property, weapon possession by a felon, dealing marijuana and possession of paraphernalia, said Evansville Police spokesman Brian Talsma.
There was no listing for Adams in the Evansville telephone directory and a call seeking comment from the Burn Em Smoke Shop went unanswered Monday morning.
