Does Ohio have a magazine capacity limit? Can a person that is out of state cross Ohio with a unloaded firearm in the trunk? Just thought I would ask, last thing I need is a trip to the gray bar hotel. I know one thing, don't speed in Ohio.:supergrin:

1. Ohio has a State Law that classifies firearms with greater than 30 or 31 round magazines as machine guns or dangerous ordnance.

2. Some large cities had magazine capacity laws, but they were pre-empted on March 14 when HB 347 went into effect.

3. It's legal to drive through Ohio with an unloaded firearm in your trunk. If you have ammo, it has to be in a separate container from the gun. I'm not sure whether the gun and ammo containers have to be locked if they're in the trunk.

HB 347 is one of the best bills to be passed. One less set of confusing laws, but Ohio still has a long way to go.

As a side note, ammo cannot be in the mags, speed strips or speed loaders(unless you have a OH valid CCW). If so, then the gun is considered loaded even though it isn't.

I dont see how loaded mags stored in a backpack, stored in my truck, with the gun in a case, in a separate area counts as a "loaded gun".

Is there a specific Ohio case which has given precidence that states otherwise?

Its the law.

Ohio law defines having a gun, ammo in a mag, speedloader, or speedstrip and in the same car as a loaded gun. I think it also states so in the Attorney General's CCW handbook-think it does but I don't have it here at work. I'm not a legal expert, but the instructor was.

One of the oddball side benefits to an Ohio CCW is this odd law does apply to CCW holders.
