The following is a news story from WLWT website. The shooting took place in Batavia (Clermont County) 25 or so miles East of Cincinnati.

BATAVIA, Ohio -- The murder trial began Wednesday for a Clermont County man accused of killing a neighbor boy for walking on his lawn.

Charles Martin is charged with aggravated murder in the shooting death of 15-year-old Larry Mugrage Jr. in March 2006.

Martin has pleaded not guilty, after dropping an insanity plea earlier this year.


His attorney said the 67-year-old believed he was being harassed by neighbors in Union Township.

“Larry Mugrage went out of his way to walk through that yard to make it a point to an old man that he couldn't do anything about it,” said defense attorney Scott Croswell.

Prosecutors said Martin confronted the boy about being on his lawn and then plotted for at least three hours before shooting Mugrage.

“He sat in his front room and he waited and he waited and he waited until that child walked back down Hawthorne Drive,” said prosecutor Kevin Miles.

Thomas Ward, a friend of the victim, testified that Martin had told Murgrage that if the boy wanted to play games, he would kill him.

“His response was, ‘Bring it, old man,’ correct?” Croswell asked Ward.

Ward admitted that it was, and he agreed with the defense that his friend’s expression was intended to stand up to Martin’s threat.

If convicted, Martin faces life in prison with no possibility for parole for 20 years.

GAH! then he had 3 hours to call the cops, find the boy's parents (since he was a neighbor) stay inside his house and drink his sorrows away! he gives responsible people a bad name.

And since the article never mentioned if he had a CCW permit or not, I am doubting he did. They'd surely have loved telling that if it were the case. I have to agree with the jury findings on this one.

BATAVIA, Ohio -- A jury convicted a man of murder for shooting a teenage neighbor who walked on his obsessively maintained lawn.

A six-man, six-woman jury deliberated less than four hours Thursday afternoon before finding Charles Martin, 67, guilty of murder.

Martin was tried on a charge of aggravated murder, but jurors convicted him on the lesser count of murder because they could not agree that the killing was planned.


Martin will be sentenced May 23. He faces imprisonment of 15 years to life, with three additional years for using a gun.

Martin didn't testify in his two-day trial in the death of 15-year-old Larry Mugrage Jr.

The defense didn't dispute that Martin shot the boy after he stepped on the lawn that Martin meticulously cared for, mowing it up to five times a week.

But defense attorney R. Scott Croswell III told jurors that Martin, a retired Ford Motor Co. worker who lived alone, had been harassed for years by Mugrage and other youths in the neighborhood.
