View Full Version : Quick question on "Castle Doctrine".
Hey Guys, does anyone know if Alabama's Castle Doctrine law addresses the issue of civil suits in the event of using deadly force?
I know that some states do not allow a civil proceeding if the shoot was found "legal".
Any clue as to where I could read the actual legislation?
Try googling HB 1097. I dont know if Alabama has addressed it yet or not.

SB-283, enacted into law.

"(d) A person who uses force, including deadly physical force, as justified and permitted in this section is immune from criminal prosecution and civil action for the use of such force, unless the force was determined to be unlawful.
To answer your question, if the shooting is legal, a civil suit cannot be brought against the victim (note, correct use of the word 'victim' as it does not reference goblin that got a few extra breathe holes).
