Hi, I have a PA CCW permit (honored in IN) and will be traveling to IN soon. Can I have my gun on me in my in waist band holster completely concealed and drive my truck?

In Indiana there is not any law on HOW you can carry. Only that you follow the requirements of your home permit/license. Please do read up on WHERE you can't carry (very few places) though.

Be advised that while Indiana recognizes all states and all foreign countries, one must carry according to the terms of his license. I.e., Texas requires the wearing of big hats and elf boots while carrying, thus Texans must maintain this dress code while in Indiana (O.K., maybe not but use it as an analogy).

Does PA require "completely concealed"? If so, you must carry that way while in Indiana.

Does that really mean to the extent of the other state laws. e.g. if a state restricts carrying where beer is sold? Or does it mean restrictions on the person e.g. the license only allows for carrying while on duty for their employment? A rather grey area in my mind.

You cannot carry on school property or casino's. You can carry in bars. You can open carry (not advised unless you are educated on the laws and are trying to make a point) or carry concealed walking, driving, riding, etc.

I was always curious about the clause tying the rules to the permit holder's state. I will offer no legal advice on the matter, but I would be surprised in any law enforcement officer would even know or care about your state's laws as long as they know you are abiding by the laws they were trained on (Indiana Law). I would not rely on this thinking, but I would also be surprised if it ever was used against you except in cases where they needed to hold you for some reason and drummed up multiple charges to justify the arrest or detention.

My understanding of the "must carry according to .... issuing state" means, if it is on the license (actually printed on it) that is how you must carry here. If it is a 'concealed firearm permit" it should be concealed, if it is a 'hunting/target/premises (like from NYC), you can carry when hunting/target practice/on your premises (which you could do anyway as an IN resident... on you own property). My PA license is a "license to carry firearms". So, as a PA resident in IN, you can do just that. You can "carry firearms", as stated on your license. IN issues a 'license to carry handguns', which is rather similar.

I've reviewed / thought about this for years. I've spoken to other lawyers and have never gotten a concise answer.

I'm to lazy to dig for supporting statute or case law, and I would not ask most trial judges opinions (as I don't think I'd get any better advise).

Other than appellate review (or better) case law or an AG opinion on case law (AG opinion is almost useless without the supporting case law). It's a little up in the air for me.

So.... after all that.... I 'd say I have no complete opinion except to say: that you'd probably need to follow Indiana law on statute and case law WITHIN INDIANA and then add in any additional restrictions placed on the out of state license (i.e. FL for example). The same concept would apply in reverse for an Indiana license in Florida.

example:
Indiana LTCH says handgun only. The Florida CWFL doesn't limit you solely to a handgun weapon. But Indiana (while you are in Indiana on a Florida CWFL license DOES).

Conversely the Indiana LTCH holder in FL doesn't get to deploy additional weapons while in Florida either. The Indiana LTCH is limited to terms of his license while in Florida.

I try and find the lowest common "restrictive" denominator. Where questions can't be easily resolved, I call the AG of the state in question, after a review of the statutes. (In many of these states the CCW laws are so new there is very little case law to go on.

Not withstanding all that.... it's still not simple.

2. He can carry a rifle around because Indiana law does not mind.

3. He must wear black socks with shorts and eat dinner at 4:30 pm, driving to the restaurant in his golf cart.:rofl:

The 'restrictions' on the license, or the issuing state's statutes applicable to the license?

e.g. a Virginia license holder carrying in Indiana shall not carry a concealed weapon in a bar (VA statute element), even though an Indiana license holder (in Indiana) may?.

As with most 'simple' things, the devil is in the details.

added: I didn't find your black socks provision in FL law. Can you give me the cite for it?
