Please read the news in todays Manila Bulletin regarding Gun Ban for the SK Elections. >:(

The prohibition on the carrying of firearms and other deadly weapons outside residence or place of business in connection with the Oct. 29 barangay and Sangguniang Kabataan (SK) elections will start on Friday, Sept. 14, and ends Tuesday, Nov. 13.

The Commission on Elections (Comelec), led by Chairman Benjamin S. Abalos Sr., said that for purposes of this year’s gun ban, firearms include airgun, side arms, long firearms, hand grenades or other explosives, except pyrotechnics, while deadly weapons include bladed instruments.

Abalos said the prohibition on the carrying of firearms outside residence or place of business include public buildings, streets, parks, and private vehicles or public conveyances.

He stressed that during the effectivity of the gun ban, the issuance of firearms licenses is suspended and it is the Comelec that shall supervise and regulate the bearing, possession, use, and transport of firearms and other deadly weapons in furtherance of its constitutionally mandated obligation to ensure the holding of a clean, honest, orderly, peaceful, and credible elections next month.

The Comelec added that from Sept. 14-Nov. 13, any permit to carry firearms outside residence or outside place of business, mission order, and memorandum receipts issued by the PNP chief or his duly authorized representative prior to, or processed and issued during the election period, are suspended unless covered by the certificates of examption or permits duly issued by the poll body.

Meanwhile, the Comelec has ruled that none of the village officials shall be considered resigned upon filing their certificates of candidacy for the Oct. 29 barangay and SK elections.

The Comelec stressed, however, that appointive barangay, city and municipal, provincial, regional, or national officials or employees, or those in the civil or military service, including those in government-owned or -controlled corporations, shall be considered automatically resigned upon the filing of a certificate of candidacy for a barangay or SK office.

Among the appointed barangay and SK officials include the secretary, treasurer, and kagawad.

In every barangay, the elected barangay officials are the punong barangay and sangguniang barangay kagawads, while the SK elective officials are the SK chairman and seven kagawads. They are all elected at large by barangay and SK voters.

The certificates of candidacy are to be filed in triplicate with the office of the election officer of the city or municipality concerned.

But in cities or municipalities where there are two or more election officers, the certificate of candidacy should be filed with the office of the election officer having jurisdiction over the barangay where he is a candidate.

Its confirmed, the gun ban starts this September 14, 2007 and ends November 13, 2007.

It was originally scheduled to start September 29 which is 30 day before election day. COMELEC however realized that certain prohibited acts, including the gun ban, are supposed to be imposed 45 days before and not 30 days before election day. Hence, in an en banc session yesterday the Commission advanced the start of the gun ban to September 14, 2007.:sad:

BUT as far as i can remember, a lot of people bought FA during the last campaign period and senate elections, including me, and granted man issuance ng license and we were given comelec gun ban exemption for a few days.

hi! i just got a text message from the PPSA president, Mr. Rommel Cabungcal and he told me that as per advise of Chief OMB, FED P/SSupt Danny Maligalig...the Battle of the Gun Clubs 2007 is a GO as scheduled on Sep 21-23....Gunban starts on Sep. 29....PPSA will request comelec for exemption, details to follow....

Im getting confused. Earlier it was posted that gun ban starts Sept 14 to Nov 13. Now its Sept 29. When does it really start?

The problem is this resolution 8298 which superceed the above resolution (Aug 08) in some aspects. This new one (8298) was promulgated 07 Sept, and was actually released by Manila Bulletin yesterday (Sept 12).

RESOLUTION NO. 8298

The Commission on Elections (COMELEC), by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, and other election laws, RESOLVED to promulgate, as it does hereby promulgates, the following rules and regulations to enforce the prohibited acts under Section 261, paragraphs (p), (q), (r), (s), (t) and (u) of the Omnibus Election Code and Sections 32 and 33 of the Republic Act No. 7166, in connection with the October 29, 2007 Barangay/SK Elections.

SECTION 1. Declaration of policy. – It is the policy of the Commission on Elections (Commission) that, during the Barangay/SK election period, September 14, 2007 up to November 13, 2007, it shall supervise and regulate the bearing, possession, use and transport of, and otherwise any dealing with or transaction involving, firearms or other deadly weapons in furtherance of its constitutionally mandated obligation to ensure the holding of a clean, honest, orderly, peaceful and credible elections.

SECTION 2. Prohibitions. – During the election period from September 14, 2007 to November 14, 2007:

(a) No person, including those possessing a permit to carry firearms outside of residence or place of business, shall bear, carry or transport firearms or other deadly weapons in public places including all public buildings, streets, parks, and private vehicles or public conveyances.

NOW, THEREFORE, the Commission hereby amends Resolutions No. 8297 and 8298 by resetting the period for the filing of certificates of candidacy, to start from September 29, 2007 and to end on October 18, 2007 (excluding Saturdays, Sundays and holidays), during regular office hours, except on the last day, which should be up to 12:00 o’clock midnight; and the ban on (a) bearing, carrying or transporting firearms or other deadly weapons; (b) use of security personnel or bodyguards; (c) bearing arms by any member of security or police organization of government agencies and other similar organizations; and (d) organization or maintenance of reaction forces, to begin on September 29, 2007 and to end on November 13, 2007. Senate junks House bill to defer barangay, SK polls

Senators on Tuesday rejected the proposal of the House of Representatives to postpone the elections of the barangay and Sangguniang Kabataan officials after congressmen approved the bill on its third and final reading, ABS-CBN News reported.

“Walang nag-express ng suporta sa pag-postpone ng barangay elections dahil pangalawang beses na itong na-postpone at malapit na rin, October 29. Nariyan naman ang pondo at nabanggit naman na mayroong pondo sabi ng Malacañang so walang dahilan para ito ma-postpone,” Sen. Francis Pangilinan told a DZMM interview.

(No one expressed support for the postponement of the barangay elections because the polls have been twice postponed and the fact that the date, October 29, is near. The funds are there and Malacañang mentioned that there are funds so there's no reason to postpone it.)

The Senate reached the consensus during a caucus called a day after the congressmen approved on the third reading the measure resetting the twin elections slated October 29.

“So ang ating payo sa ating mga kababayan na apektado nito ay maghanda na sila. Ang naging kontento sa Senado ay ituloy ang barangay elections,” Pangilinan said.

(I would advise the public to prepare. The Senate decided to push through with the barangay elections.)

Senate Minority Leader Aquilino Pimentel Jr. earlier opposed the postponement of the polls. He pointed out that barangay officers have overstayed for two years and SK officials are already beyond the age limit because elections did not push through in 2005. The present crop of officials was elected in 2002.

On Monday, a total of 149 congressmen voted for the postponement, 15 were against it and four abstained.

Proponents of the bill want the village and youth polls rescheculed to 2009 because according to them, the country had just finished with the May midterm polls. They added that the government should wait for the computerization of the elections.

The Commission on Elections, meanwhile, said over the weekend that the barangay and SK polls will not be automated.

COMELEC Chairman Benjamin Abalos, however, said that the commission is ready to hold the village and youth polls next month. He added that computerizing the polls would mean deferring the political exercise to November.

Abalos said that despite the delay in the computerization, the COMELEC will attempt at automation and hold mock polls in the first week of November to test the equipment.

Meanwhile, the Senate caucus was also called to decide on what to do with government executives who ignore its summonses to testify in investigations and hearings in aid of legislation following the refusal of Malacañang officials to attend the “Hello, Garci” and ZTE-National Broadband Network deal probes. The Commission on Elections (COMELEC) urged gun owners Saturday to apply for exemption from the election gun ban that would be strictly implemented during the campaign period from September 29 to November 13 this year for the barangay and Sangguniang Kabataan elections.

COMELEC spokesman James Jimenez said applications for exemptions should be filed at the COMELEC’s Committee on Gun Ban at the poll body’s main office in Intramuros, Manila.

Jimenez added that applications would be reviewed thoroughly and the COMELEC will strictly enforce the gun ban during the period.

The COMELEC has issued a resolution, supervising and regulate the bearing, possession, use and transport of firearms or any other deadly weapons to ensure peaceful and orderly elections.

The resolution defines firearms as air guns, side arms, long firearms, hand grenades and other deadly explosives, except for pyrotechnics, while bladed instruments are considered deadly weapons.

yes, the definition of firearm includes ammo.

1st day ng gunban yesterday. celebrated inside the range pumped some 200rounds on my .22lr rifle. no i didnt violate any gun ban law. i had my f/a deposited in the range's vault for safekeeping

Police have arrested the suspect in the killing of two persons following a traffic altercation in Pasig City past 2 p.m. Tuesday, ABS-CBN News reported.

Senior Superintendent Francisco Uyami, city police chief, said lawyer Manuel Hernandez Jr. was arrested shortly after the incident at the entrance gate of Barangay San Antonio Village on Shaw Boulevard.

Uyami said the suspect was collared at his home.

Police named Hernandez suspect in the fatal shooting of Egadrdo Canizares and Katherine Palmero.

Witnesses told police that the incident took place around 2 p.m. when Canizares's Nissan Cefiro (XSA 205) nearly ran into Hernandez's Toyota car (UEP 547) that was about to leave the village near the corner of Shaw Boulevard.

Following the near-accident, Canizares alighted from his car and hurled invectives at Hernandez.

The suspect initially ignored Canizares and drove on. Canizares, however, kicked the suspect's car and forced him to draw a pistol and open fire.

Witnesses said after shooting Canizares four time, the suspect vented his ire on Palmero.

Authorities took the victims to The Medical City hospital. They died while undergoing treatment.

The assailant, meanwhile, escaped on board his car toward Pioneer Street. With reports from Sol Aragones and Ricky Velasco, DZMM

i heard on the news that the victim was really taunting the lawyer calling him "bakla! bakla!" and other profanities and daring him to come out and fight. and when the lawyer ignored him and started to drive away, he kicked the lawyer's car. that's when the lawyer shot him. anyway, still not a reasonable act unless the victim's foot is considered a lethal weapon :banana:

btw back to the gun ban issue, may narinig ako balita sir nga 1 vote na lng raw sa senate eh postpone na election. is this true sir? medyo naka apekto ba yung resignation ni abalos? kasi for me they would prefer to postpone it muna kasi hindi nila (the administration) yung election until kontrolado din nila yung chairman d ba? :)just my opinion mga sir ah

Lets do some Analysis on the situation:
-the suspect has CAR and GUN
-the victim has CAR
We can then assume that both of them are from either RICH or Middle-Class family.

this means the victim's family can afford to hire a good lawyer to prosecute the suspect and hopefully send him to death row.

Now, kung hindi magdedemanda yung family ng victim (dahil wala ng death penalty)... this only means that the suspect has 2 options:
1) buy ticket going to US with his family at wag na bumalik ng Pinas.
2) mag imbak ng maraming Ammo and convert his car into armoured-car.

money + connections = capability
(what capability? your guess is good as mine :))
