Hey Guys,

I was at the range yesterday (Saturday) and the guy behind the counter asks me if he can inspect my weapons before shooting. I am always reluctant to let others handle my weapons, but since he worked there I let him inspect them.

The first one I gave him was a S&W 442. He immediately said "Wow this is the new M&P." To which I replied "no, it is a model 442." He argued with me and flips it over to show me the S&W logo and said "see right here, this is the new M&P. This is a $800 gun. We've only seen a few of these come through." I told him that if it was a $800 gun I only paid $390 for it so I got a great deal. He said "yeah I know, that happens alot." Just to shut him up I said "well if you really like it I will sell it to you for $500." He was excited and said "OK." I just bought the gun last week and can pick up another one for $390.

We have not made the transaction yet, since I told him I would bring him the case on Monday and we can make the exchange then. My question is whether or not I may be doing something illegal by representing the gun as a model it truly is not? Any advice out there? Should i proceed or is it just not worth it?

Thank you for your help.

The model number will be stamped in the frame where the cylinder yoke closes, should say '442-.....'
The M@P is a different gun, has scandium (not plain alloy like 442) frame and stainless cylinder (carbon steel on 442)
442 is also a .38+p, not .357mag like M@P.
By all means, take advantage of the fool. :)

I think you may know the answer to your question already, or you would not have asked us it. Tempting though, isn't it?

Just because we encounter a buffoon does not mean God placed him there for our personal enjoyment.

Beat me to it. You don't seem to feel right inside don't do it.

Think about the next time you have to go shoot there.

Well just to let everyone know... I did not sell him the gun.

I went back (brought the gun with me) and asked him to pull out the 442 they had in thier counter to do a comparison. We went over both guns point-by-point and after noticing there is absolutely nothing different he finally agreed with me. Jokingly I did tell him that the offer still stands if he wants to buy it. He told me "I will think about it." I hope he was not serious.

Good job, Roy. You did the right thing, and what goes around comes around.

Wait a minute. I have an old, original S&W Military & Police revolver (circa 1903), but my understanding was that the new M&Ps by Smith were Semi-Autos. Are you all telling me that they have a new M&P 'revolver'?

This is the first I've heard of it!!!!!

Yeah they have M&P designated revolvers. 340 M&P, 360 M&P. Here's an article on one of the 340 M&P's.
http://www.gunblast.com/SW-340MP.htm

I think the differences between the regular 340 and the 340 M&P are minor and mostly cosmetic. The M&P series has a lanyard pin and XS Big Dot tritium front sight and wider U notch rear sight I believe. There may be one other difference that I'm forgetting.

Once he buys it from you, he'd probably be too embarassed to do anything about it.
