View Full Version : My Dealer sold my Snubbie!

So, I buy a new Taurus 605 on Dec. 14th from my LGS.
Then as I dry fire it it begins to develop cylinder lock-up. So on Dec. 31st I take it back to the dealer and they send it back to Taurus.
I stop by two weeks ago and inquire and they assure me (without looking anything up) that they will call me when the factory returns the gun.
Today I call and ask for the phone # for Taurus so that I can call and check to see what is happening.
Taurus tells me that my gun has never been returned to them but that I did give them a valid serial number.
I call my LGS and they then call Taurus. It ends up that the LGS sent the gun to Taurus without doing the proper warranty request and so it was returned to them.
They no longer have my gun but are ordering one in for me and it will be here soon.
What the H*** kind of deal is that? and no they were not willing to give me my $ back but I could buy different gun if I wanted to.
I doubt I will buy a gun from these guys again, this was my first and it was on sale for a pretty good price.
Last gun I bought was a M&P9c. I asked them their best price and it was almost $100 more (after transfer fees) than another dealer who has a brick and mortar store but is in another state.
Disappointing all around since I like to support my local guys but not when I have to deal with this sort of crap!

Sounds like LGS knows he is the only game in town. Believe it or not, you can tell them you want your money back even if they act like they don't have to. Just tell them you will contact the BBB, local Chamber of Commerce, etc... Of course, if they are the only game in town with no FFL's close by, they have you by the short hairs.
My advice is find an FFL who will handle transfers and buy from online places like Buds, Impact, etc...

So your dealer sold you a defective gun, you returned it, then they basically resold the same defective gun to someone else?!?
I guess you could tell them they can give your money back or you'll give the ATF a call.

i'd drop a dime to the ATF, and see if maybe they couldn't do an audit. just to be sure my gun wasn't floating around where it shouldn't be. and cause i'd be pissed off at the thieving SOB's. you bought it. what you wanna bet if it's found it tracks to you?
mitchrader has a good point, who knows were your gun is? It may be a good idea if ATF herd about this to keep you safe and out of a jam.

I am sure most gun shops are legit but all it takes is one bad apple out there and he gives all the anti-gun rights folks another reason to hate us. Not to mention that your gun was illegally re-sold. DEFINITELY notify the ATF.

I would only call ATF as a last resort. Losing a firearm is a BIG DEAL for an FFL and not a pretty sight.
But, I would try everything else first, including the threat of ATF.
I'm not protecting the dealer, but I really hate for the ATF to get any kind of stat on any dealer.

I'd get some documentation from the shop detailing that the gun has been resold and is no longer in your posession. Then take your store credit and either get another Taurus or whatever you want.

you on the form, gun missing. i'd sure get SOME sort of paperwork said i was NOT the owner of that gun, and get it filed someplace official, at the minimum. CYA. you ain't got a spare..

I plan to discuss this with the dealer today... Have been waiting to cool off before I go in.
My plan is to take the replacement gun (another new 605) after they have provided me a letter stating that I am no longer the owner of the first gun.
If they give me any trouble I will go straight to the BATF and let them work it out. I would hate to think that it would come to that (I believe it was a incredibly stupid but honest mistake).

The rest of the story...
LGS owner explains to me that they found the gun on their shelf when I called back the second time and send it back to Taurus with a Return Authorization. So, rather than have me wait another 8-12 weeks for Taurus to return my gun they decided that they would order me a new gun (or give me in store credit).
I took the replacement gun (another Taurus 605) and when he wrote my receipt he put the original gun on it as a trade-in.
So, I have a 605 and a receipt for the trade-in.
I am assuming they are being on the up and up since they have dated paperwork that says I traded the original gun in on March 24th.
I sure wish the guy I has spoken with the first time (employee) would have been more accurate with what he told me. Telling me they no longer had my gun but they would order a replacement in for me was not quite accurate....
Still not a good feeling for my first deal with these guys but I will not bad mouth them. I will however deal with the owner from now on!
Thanks for the advice and I will be sure to post a AAR when I have a chance to get it to the range.
I plan to clean this one really well before I do any dry firing too!

Made a quick trip to the range today and shot my new snubbie.
Only 40 rounds of .38 but it shot really well!
Only issue I found was the POI is 3-4" to the left at 15 yards (approximately).
I am thinking of bobbing the hammer and having the rear sight notch widened. If so I hopefully can correct the POI issue.
I like it! I've never had a snubbie before.
I look forward to shooting some .357s next time :supergrin:

So you took the gun back to the dealer on 12/31/07? They "lost" it, Taurus never got it. You griped about it, suddenly they found it and gave you a "trade in credit" for 03/24/08 on a handgun that has been out of your control for how long???
Not to sound paranoid, but let's play "what if?" What if it was misused, not misplaced? As far as your "paperwork" shows, you still owned the gun on 02/21/08 when it could have been misused.
Like I said, not to sound paranoid. I would demand they provide a notarized letter(in triplicate) stating when you brought the gun in, what happened during this period, and what was done to rectify the issue. If they refuse, call the ATF.
