I'm afraid to just pay the deposit. The law allows, if the background check doesn't go through, for the seller to keep your deposit. Since a lot of the check depends on the salesperson correctly writing information on forms, it seems like too great of a temptation, to trust that they won't screw if when they can.

I've never heard of anything bad like that actually happening.
