A Fatal Accident on Thursday

I drove past the carnage. There were several men holding a screen up so that the passers-by couldn't see anything. I knew it had to be ugly.

On the way back home, the screen was down and the tow trucks were on scene. Head on collision between a pickup and a mid-sized car. This was on the one-way access road of I-37 North-bound. The idiot in the truck was headed south. Witnesses said that he often went the wrong way there, because it was shorter for him.

We are learning more about both the driver and the victim of a wrong way traffic accident on the I-37 Access Road Wednesday. Police suspect the wrong way driver, a 25 year old, was under the influence of drugs when he crested a hill and collided head on with another vehicle killing the other driver instantly.

The victim of this accident was a well known businessman in this community. 47 year old Woody Sanderfer is survived by his wife, three grown children, and 9 grand-children. His sudden loss is having a dramatic and tragic affect on his family. They elected a family spokesperson, and a longtime friend of Woody's, Danny Simmons to speak on their behalf.

"I don't know anyone who didn't like him," said Simmons. " He had a heart of gold. He would do anything for any of his friends"

The accident happened Wednesday on the Access Road of I-37 near Magee. Police suspect, 25 year old Steven Pena, was driving under the influence of heroin when he went the wrong way on the Access Road in his pickup.

Police say a witness claims Pena would go the wrong way on the Access Road all the time using it as a short cut.

Three news investigated today and learned through public records that pena didn't have a valid driver's license, and two hours prior to the fatal wreck, pena was stopped by police for going 15 miles an hour over the speed limit. He was given two citations.

"At that point he did not have any outward signs of being under the influence." said Corpus Christi Police Captain Michael McKinney.

Pena reportedly underwent surgery on Thursday for a broken ankle. He is under guard held for Manslaughter. But, police say when a positive blood test returns the charge could change to Intoxication Manslaughter.
Why can't they take the keys away and have their vehicle towed, when they stop an unlicensed driver, rather than issuing them citations?

He didn't have a valid license, 15 over, and he drives away and kills someone. Why was he allowed to drive away from the traffic stop?

Why can't they take the keys away and have their vehicle towed, when they stop an unlicensed driver, rather than issuing them citations?
It is an arrestable offense in TX. I'm sure the officer on the original offense wishes he had decided to hook him when he had the chance. If it was something simple like his license being expired, most of us would not want to see everyone arrested for every traffic offense.

Yeah. He or she is feeling awkward right now, I am sure. What to do? It's not the COP's fault the guy caroomed into another vehicle, it's the idiot who drove the car.

I think in NY if you don't have an actual license (not failure to produce), and you are cited with a moving violation, the car uses one gear for the rest of that day - "PARK".

WTF? Have you ever been to South Texas?

I think you've been led out of your ****in' mind with the hatred of Hispanics. A HUGE percentage of the population here is Hispanic, and most could likely trace their lineage on this land back to before Europeans came here.

It doesn't even go that far, around here. Most people here are of Hispanic heritage, have Hispanic names, Hispanic faces, Hispanic complexion, but speak very little Spanish, if any at all.

Hell, I was raised as a Cajun. My grandparents spoke fluent "Cajun French", but I only knew a few select cuss words.

These Hispanic people also tend to serve in the US Armed Forces more than any other group of people I've lived among before.

I didn't start this thread to bash Hispanics. I just saw the aftermath of the accident, and I knew that someone was killed on the scene. I'd have been equally pissed regardless of the heritage of the killer.

Does anyone else have any thoughts or comments on whether or not folks who aren't licensed to drive vehicles should be given a piece of paper and allowed to drive on?

No liscense or insurance you should not be driving.

We have tried to pass laws around here to have cars towed if you do not have a license or insurance. Guess who fought that? And guess why? Sorry didn't mean to bash

I think it depends on the charge. No insurance in these part means the police parks your ride or have it towed.

speeding over 15mph, they can haul you into lockup or issues a citation and release you.

Different dpts have different policies.

I understand. I know what you mean. I just feel compelled to point out that the majority of people around here are Texans, regardless of their name, heritage, or skin color.

The folks you're talking about, who fight such things, represent a small minority whose actions affect us all.

I would think that no license would automatically invalidate any insurance that may be attached to either the driver or the vehicle.

You hit the nail on the head with that one. Although my father immigrated from Mexico in the late '60s, on my mother's side of the family we can trace our lineage back to when the Spaniards were running around spreading their diseases amongst the Native American Indians for the first time.

And you don't even have to go to southern Texas to find the same situation as mine. Hell, I was born in Longview and that is just a stones throw from LA.
