Getting An Auto Knife Shipped to Florida
Happy Memorial Day!
I just ordered a Spyderco Citadel from Blade HQ this morning. It was one of those impulse buys I did after seeing a review on Youtube. After I placed the order I realized there may be some legal issues with shipping an auto knife to Florida.
After reading the laws about restrictions on shipping auto knives across state lines I wonder if Blade HQ will even ship it to me. Should I call them tomorrow and ask or just let it go?

Having it shipped here...and carrying it here are two different things. Doubt the UPS/USPS patrol will care what knife your getting in the mail. However carrying said knife with you is another story.

You can carry an auto in Florida with a CWP.
Anything else will be a case study. Knife laws are to say the least ambiguous. Most Florida courts have agreed that a common pocket knife with a blade less than 4" is not considered a weapon.
Unfortunately it's not up to us as to what constitutes common.
For $117 and a few signatures you can have a CWP if your eligible and not worry about carrying it.

I have a CWP and I know I can carry it in the state.The question is will I have any problems getting it shipped to me from Blade HQ? Has anyone else in the state of Florida received an auto knife from Blade HQ?

I have not bought from Blade HQ before but I have purchased knives directly from Benchmade that shipped direct to me and I was not LEO or Military at the time. If they didn't require ID from you at the time of purchase you should be receiving the knife shortly.

(3) to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of any State or Territory, or any county, city or other political subdivision of a State or Territory; (4) to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs (1), (2), and (3).
Sections 1242 and 1243 of this title shall not apply to -
(1) any common carrier or contract carrier, with respect to any switchblade knife shipped, transported, or delivered for shipment in interstate commerce in the ordinary course of business;
(2) the manufacture, sale, transportation, distribution,possession, or introduction into interstate commerce, of switchblade knives pursuant to contract with the Armed Forces
(3) the Armed Forces or any member or employee thereof acting in the performance of his duty;
(4) the possession, and transportation upon his person, of any switchblade knife with a blade three inches or less in length by any individual who has only one arm; or
(5) a knife that contains a spring, detent, or other mechanism designed to create a bias toward closure of the blade and that requires exertion applied to the blade by hand wrist, or arm to overcome the bias toward closure to assist in opening the knife.
Blade HQ will not sell to any individual or group outside the State of Utah without the above conditions being met. This does not apply to automatic knives manufactured, distributed, purchased or sold within the state of Utah. Proper identification may be required before the order is shipped in cases where restricted items are purchased.

I'm no lawyer, but it appears to me that automatic knives are not illegal in Florida. There is a lot of reading to do, but here is Florida's law on weapons.

I'd like to have an automatic knife just for the novelty of it, but I'm happy with my assisted opening Kershaw. It opens fast and quietly.
Some states do prohibit automatic knives and I don't want to worry about that. Strange that I can carry a concealed firearm in 30+ states but an automatic knife could land me in jail.
Politicians are a weird bunch.

Gotcha... sometimes with Govt it's tough to keep up with.
Google it and you will get a dozen different answers. I carried a Benchmade OTF 3300 for years, but I was with the Fire Department and PD/SWAT Medic...so I was "exempt". I have had my Concealed.
So I guess the "only" thing illegal in Florida is ballistic knives. All other knives are legal to carry unconcealed. concealed, with a ccw all other knives are legal to carry. but............that is State law and each County and City may or may not have their own ordinances.
You should verify what they consider legal by their ordinances.
I believe there is a law being worked on by Florida carry and knife rights to have a one set of rules in Florida knife law to be the end all be all, much like the one set of guns rule in Florida that passed last year or so......but I don't know the status of it yet. I need to be more aware of them.

Thanks for the answer Syntax.You live in Florida and have had autos shipped to you without any issues so I am going to let it go and see if they ship it or not.

There are no county or city exemptions that I am aware of. I am not aware of any knife legislation that passed recently in that regards.

http://www.floridacarry.org/issues/knife-preemption has some barebones info on the effect of local ordinances regarding knives (and/or weapons other than firearms).
It is important to remember that Florida's pre-emption law (FSS 790.33) only applies to firearms and ammunition. Unfortunately, local governments are still able to apply the patchwork quilt of regulation to all other items.

You can carry it in Fl no problem. Just be aware that a lot of the Police do not know about the legality of the knife. Ive never had an issue and have a LEO buddy who did not know the law had changed in 2005 I believe it was.

I'm sure you have. You likely just know them as switchblades. Auto knife is the preferred term.
