An Ar 15 question.
Hello,
I got A2 complete 16" ar15 upper with bayonet lug and birdcage flash hider. I am in OH, buyer is in Albany NY. With all that craziness going on....Am I allowed to sell it to him? Want to help him, but do not want to brake the law.
Would love to hear from FFL guys from NY, but anybody is welcome.

No you are not allowed to
I am not positive but I believe that would have been banned even before the current mess of laws was passed.

New York has become the new California...you can double check with your FFL, but I don't think it can be done. I take it your stock is not pinned as well? No telescopic/collapsible stocks allowed....but that can be changed, and your flash hider can come off. As for the bayonet lug, don't think that can be on as well.

I think the post was edited after I commented. If it is just the upper...the OP might be able to sell it to him, what he does with the upper afterwards is not the seller's responsibility. You don't need an FFL to purchase an upper. But with all these stupid new laws in NY....who knows.

The 'firearm' is the serial numbered part, therefore selling only an upper would not break the law. Just like having an m16 bcg does not make your AR fully automatic.

It has features that are banned under NY's laws.
OP, find someone in the other 47 states that are legal to own it.

If you have a semi automatic firearm it cannot have a threaded muzzle, if it does it has to have the muzzle break permanently installed, like they do on the 14.5 inch barrels to get them to 16 inch. Selling it to a person could be construed as selling "assault weapon" parts. It's been banned since the 90s IIRC.
Just having a flash hider is legal from what I remember, but having any semi auto with a threaded muzzle and the flash hider isn't. You can still use it on a bolt action from what I recall. Don't take my words for gospel, look into it yourself.

I think if it has a pistol grip, no muzzle break allowed. It wasn't always like this, I bought an AR in NY that had all the bells and whistles a good 10+ years ago when I lived there. Now...Bloomy is ready to ban gun magazines (the kind you read), lol. Like I said, NY is the new CA. I have so many LEO friends in NY...and they are so pissed with these new laws. Soft drinks are going to be on the ban list as well! Glad I no longer live there...

I'm in NY, dont do it!! I'm not sure what could happen to you, but the buyer is an idiot.
From Wikipedia NY Safe Act:
Reduces definition of "assault weapon" from two identified features to one. The sale and/or transfer of newly defined assault weapons is banned within the state, although sales out of state are permitted. Possession of the newly-defined assault weapons is allowed only if they were possessed at the time that the law was passed, and must be registered with the state within one year.
