NC pistol permit question? Long question

Ok here it goes. I live in Greensboro North Carolina

I had in the past (2 years ago) filled out a pistol purchase permit form and turned it into the sheriffs office. I was awarded the permit, then in the same day bought my first pistol (G 19). Since then I have bought 2 others and a long rifel. All before 2007, this was the good part.
I was pulled over on Jan 1st 2008 this year for having out of state and out of date tags on my car. I then was informed that I had a suspended licence for not paying a speeding ticket on time because of an error on the states computer on Dec 18 2005. So I have been driving for over a full year with a suspended licence.
On Jan 1st 2008 I was given 2 tickets, one being driving with a suspended licence and not having the vehicle registered in NC. The infraction numbers are G.S. 20-28 and G.S. 20-111. The second ticket is not having insurance on the car. I brought the car down from home (Maine) this Christmas and had not taken care of the registration and insurance yet, plus the title of the car had just been changed to myself for buying it 10 days before. The infraction numbers for this ticket are G.S. 20-313.
Now my question is with these just being minor trafic violations (minor as far as I know) will this keep me from getting more pistol permits? I have taken care of the speeding ticket by paying a fine. Have registered my car with the state, got a NC title, bought the proper car insurance, and had my licence reinstated. I have a manditory court date on Feb 1st 2008 for my two new tickets. So if I were to go to the sheriffs office and apply for more permits the state would see that I have an open court date and unresolved trafic violations, would this be a problem?

No this should not stop you from getting a CCW. The things that they check for is any type of felony charges or and domestic violence conviction. As for your insurance, tags and driver's license believe it or not they are all misdemeanors. It is my agency's policy to arrest anyone who is driving while they have a revoked drivers license.

Wilson, I think he is talking about pistol purchase permits, an NC requirement when buying a handgun. It is NCs way of dealing with mandatory waiting periods.

Glaze22, I don't think it should cause you any problems, but Feb 1st is just a couple weeks away, it might be better to wait, get the court date out of the way first. As I understand it, the pistol purchase permits go through the same kind of check you would get in another state when buying a handgun. The usual "Felony, mentally ill or domestically combative" type stuff.

Thanks for the info. Wilson, the officer said the reasion that he was not going to arrest me is because there was no warrent out for my arrest. He said most countys put a warrent out if you fail to show up for court. But for some reasion it showed no reason why it was suspended and that he could not find any info except that it dated back to 2005. I did not know that my offences are all misdemeanors, that is very good to know.

Just one question, why don't ya have your CHP? That would do away with the purchase permit hassles!

I am planning on getting my CCW in the next couple of months. It's just that the gun show is coming next month and I want to be able to get something if I see it.

How NC court system does it is if you fail to appear for an infraction they revoke your license. If you fail to appear for a misdemeanor then they issue a order for arrest for you. You best best to figure out why your license is revoked is to go to DMV and have them pull up your record. They will be able to tell you in what county you have an unpaid ticket.

I had the samething happen to me about 12 years ago. I was drunk and riding as a passenger in a vehicle. Well we got pulled over and I was given a ticket for not wearing my seat belt. Well I got deployed overseas before my court date and when I came back I forgot all about it. I did not know anything about it until I went to renew my license and they told me that they were revoked.

I already payed my ticket and have my licence back, I just have a court date now for the two new tickets that I got on Jan 1st. I just wanted to make sure that I could get a permit or not. I am going to wait till after my court date to get some more.

There is no such thing as a mandatory waiting period, and it is simply a way for the county to rip us off.

Ok, I meet with my lawyer today. As Wilson had said before all my trafic violations are misdemeanors. I am awaiting a hearing on Feb 1st to find out how much trouble I am in? If I apply for permits before my hearing and I get denied, do I have a wait period before I can apply again? I was told 1 year by a co-worker, but I dont really trust his input. I just dont want to put myself in a bind.

I don't think there is a set time limit. By state law, it is left up to the Sheriff's discretion, as to whether or not they feel you are of sound moral character. Although the misdemeanors may get you past the federal NICS check, that doesn't mean you are going to get past the Sheriff. At that time, you are at his mercy. Because of this, I bet the only thing you can do is ask the local permit issuer, what your options are should you be denied. They probably have a local policy they follow.

Personally, I wouldn't even bother applying until the mess was taken care of. If you do, it makes it look you are trying to fly under the radar. That perceived sneakiness alone could get you denied, whereas the stupid misdemeanors may not, once dues are paid and all that stuff.

After getting a traffic attorney to take care of a ticket I had in Wake County when I was living in Greensboro, and seeing what he was able to accomplish, I've used one every time I've gotten a ticket. His services cost more upfront, but I've saved at least that much money by not having my insurance rates skyrocket.

What is it you think he did for you? In my experience, they can't do anything for you that you can't do for yourself. They are just saving you the time of appearing, and the inconvenience of learning about a few laws, and how they work, on your own.
