Appeals on VA Disability

For anyone who has a disability rating from the VA and you appealed, how long did the appeal take?

I filed an appeal in July of 2005 and it is still going. I didnít have my Compensation and Pension exam until April of 2007 and I have not heard anything since.

This is starting to annoy me.

I want to say mine was about a year.


And by the way they said "yes we agree with you it has worsened but in the last couple of years the rules changed from when you were originally awarded disability so now even though it has worsened and met the requirements for upgrade before, you are not eligible for any additional percentage at this time."

This was in 06 I think.

I am paraphrasing of course.

Get your congressman involved and it's surprising how they SUDDENLY get all the paperwork together and come up with a decision in your favor. St. Louis VA is the worse one to deal with....totally incompetent and total A-holes.

That's a good idea. I need to get something together. I keep trying to call and see where it is at. Chicago regional office says my claim is in DC. DC says they have never seen it, its in Chicago and depending on who I talk to on the phone, one person will say the VA has reached a decision and I will be recieving a letter shortly (months and months go by) while others say the VA is still working on it.

Just the other day I got a letter dated March 21st thanking me for my call on March 24th...It's almost like they can see into the future.

I am in the St. Louis region and I have not talked to anyone outside the VA about it.

My original claim, resulting in 30% disability took 22 months. The appeal (to 40%) took another 18. I wasn't too surprised with the time it took and they provided back pay.

Your wait/delay is typical.

I live in Ohio, CONGRESS HAS INDICATED THERE WAS A DISTINCT INEQUITY IN THE WAY VETS WERE GETTING TREATED, READ CHEATED for 25 years, by our region! THE VETERAN'S SERVICES were ordered to fix things by re-evaluating millions of vets, they pencil whipped the exams and made little change, still cheating the vets.

New Mexico region pays a vet in my condition at 100% for an 80% rating, which I should be as my condition have gone from painful to diagnosed arthritis.

So should I contact a State congressman or a U.S. congressman? I am writing up letters to send out both through email and regular mail in hopes for a response.

I have also thought about asking the VFW and the American Legion for help since I am a member of both.

go here http://www.house.gov/

punch in your zip code in the top left corner and then once you get to your Rep's page look for the contact info and pick the office that is the closest to where you live. The quickest way to get a response is to call the local district office and they should be able to help you out.

So I contacted a Conressman, informed the VA I was doing so and two weeks later, they want to make a deal with me.

It really works!

YMMV My buddy contacted our Congressman at the time and it made no difference.

Well the Congressman hasn't done anything yet. I called regional and asked to speak to a supervisor, got his name and let him know I was going to my Congressman later on and needed a point of blame-I mean contact.

Within a week, things are starting to roll again.

Howdy,

What you need to do is go to the VA inperson and talk to a VSO ( Veteran Service Officer). Try using the DAV or the VFW. Myself, I use the Ark. Dept of Vet Affairs.

Also, get a copy of your C&P exam. I have to go to my local VAMC for this (release of infomation).

It's all about filing claims with the VA, etc.

This is the best source of info on the net.

Another thing that you need to do is study the CFR dealing with the VA and disibility rates, ratings, and the process. Here's a link........

I hope this helps. Since I'm service connected, I have been fighting/dealing w/ the VA for several years and one thing for sure is that the employees at the VA will lie to you. It's part of their job.

I was at the RO back in July and a VSO told me that I could not file for an increase on the rating on my rt knee because 38 CFR Subpart B Section 4.116 states that the maxinum rate payable for bursitis is 10%.

Since I have done my homework, I realized that Section 4.116 referrs to women's health issues and not knees. I pointed this out to the VSO and he kinda got mad because he realized that I knew he was trying to BS me.

Do your homework, you are the only person on your side.

It took my dad 11 years from the time he got out to the point where he was put at 100% disabled/unemployable. That was with help from the DAV and people who he knew that had gone through the system.
